CONCERNING
THE AMENDMENT TO DECREE OF THE MINISTER OF FINANCE No. 456/KMK.04/2002 ON THE EXTENSION OF THE IMPORTING PERIOD OF MACHINES, GOODS AND MATERIALS SECURING FACILITIES UNDER DECREE OF THE MINISTER OF FINANCE No. 135/KMK.05/2000 REGARDING THE RELIEF OF IMPORT DUTY ON THE IMPORT OF MACHINES, GOODS AND MATERIALS IN THE FRAMEWORK OF THE DEVELOPMENT/EXPANSION OF INDUSTRY/SERVICE INDUSTRY

THE MINISTER OF FINANCE,

Considering:

a. that in the framework of developing refined sugar industry, it's necessary to change the policy on the granting of facilities to the import of goods and materials for the need of the sugar industry as regulated in Decree of the Minister of Finance No. 456/KMK.04/2002;
b. that based on the considerations as intendedintended in sub-paragraphs a and b, it is necessary to stipulate a regulation of the Minister of Finance on the Amendment to Decree of the Minister of Finance No. 456/KMK.04/2002 on the Importing, Period of Machines, Goods and Materials Securing Facilities under Decree of the Minister of Finance No. 135/KMK.05/2000 regarding relief of import duty on the import of machines, goods and materials in the framework of the development/expansion of industry/service industry;

In view of:

1. Presidential Decree No. 20/P/2005;
2. Decree of the Minister of Finance No. 456/KMK.04/2002 on the Extension of the Importing Period of Machines, Goods and Materials Securing Facilities under Decree of the Minister of Finance No. 135/KMK.05/2000 regarding relief of import duty on the import of machines, goods and materials in the framework of the development/expansion of industry/service industry;
3. Decree of the Minister of Finance No. 135/KMK.05/2000 on relief of import duty on the import of machines, goods and materials in the framework of the development/expansion of industry/service industry as has already been amended the latest by Regulation of the Minister of Finance No. 47/PMK.04/2005;

HAS DECIDED:

To stipulate:

MINISTER OF FINANCE REGULATION CONCERNING THE AMENDMENT TO DECREE OF THE MINISTER OF FINANCE No. 456/KMK.04/2002 ON THE EXTENSION OFTHE IMPORTNG PERIOD OF MACHINES, GOODS AND MATERIALS SECURING FACILITIES UNDER DECREE OF THE MINISTER OF FINANCE No. 135/KMK.05/2000 REGARDING THE RELIEF OF IMPORT DUTY ON THE IMPORT OF MACHINES, GOODS AND MATERIALS IN THE FRAMEWORK OF THE DEVELOPMENT/EXPANSION OF INDUSTRY/SERVICE INDUSTRY

Article I

The provisions of Article 3 paragraphs (1) and (2) of Decree of the Minister of Finance No. 456/KMK.04/2002 on the Extension of the Importing Period of Machines, Goods and Materials Securing Facilities under Decree of the Minister of Finance No. 135/KMK.05/2000 regarding relief of import duty on the import of machines, goods and, materials in the framework of the development/expansion of industry/service industry are amended so that Article 3 reads as follows:

"Article 3

(1) The facility of extension of the importing period does not apply to:

a. the import of goods and materials realized from May 1, 2002 to the date when Decree of the Minister of Finance No. 456/KMK.04/2002 entried into force after the expiration of the importing period on the basis of decision on the granting of facility;

b. the import of sugar before the enforcement of this regulation.

(2) In the case of the import being realized in the period as intendedin paragraph (1) by paying import duty, restitution of the paid import duty cannot be requested.

(3) The quantity of the imported goods and materials as intended in paragraph (1) sub-paragraph a can be excepted from the quantity of the import provided with the facility of extension of the importing period as intended in paragraph (2)."

Article II

The regulation comes into force as from the date of stipulation.

For public cognizance, the regulation shall be published in State Gazette of the Republic of Indonesia.
